These Terms of Service ("Terms") govern your access to and use of the website located at https://trustedhumans.ai and all related services (collectively, the "Service"), operated by:
References to "we," "us," "our," or "Trusted Humans" throughout these Terms shall mean the above-identified entity.
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and Trusted Humans.
If you do not agree to these Terms in their entirety, you must refrain from accessing or using the Service. Your continued use of the Service following the posting of any modifications to these Terms shall constitute your acceptance of such modifications.
The Service is intended for users who are at least eighteen (18) years of age. By accessing or using the Service, you represent and warrant that you are of legal age to form a binding contract with Trusted Humans under applicable Portuguese and European Union law.
If you are entering into these Terms on behalf of a legal entity, you represent and warrant that you have the authority to bind such entity to these Terms.
To access certain features of the Service, you may be required to create an account. When registering, you agree to provide accurate, current, and complete information and to maintain and promptly update such information to keep it accurate, current, and complete.
You are solely responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] upon becoming aware of any unauthorized use of your account or any other breach of security.
We reserve the right to suspend or terminate your account, refuse service, or remove or edit content at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, third parties, or our business interests, or for any other reason.
The Service provides AI-powered analysis to detect and identify the presence and implementation of artificial intelligence technologies on websites and digital content. This analysis is intended to promote transparency regarding AI usage and help users make informed decisions.
You acknowledge and agree that the AI-powered analysis provided by the Service may not be completely accurate. Due to the inherent limitations of artificial intelligence and machine learning technologies, including but not limited to:
The analysis results may contain false positives (incorrectly identifying content as AI-generated) or false negatives (failing to identify AI-generated content). The scores and assessments provided should be considered as indicative rather than definitive.
The Service is NOT a security audit, penetration test, vulnerability assessment, or cybersecurity service of any kind. The analysis provided does not evaluate, assess, or certify the security posture, compliance status, or safety of any website, application, or digital content. You should not rely on the Service for any security-related decisions or compliance requirements.
Trusted Humans reserves the right to modify, update, improve, or replace the AI scanners, detection algorithms, analysis methodologies, and scoring systems at any time without prior notice. Such modifications may result in different analysis results for the same content over time. We continuously work to improve the accuracy and reliability of our analysis, but cannot guarantee consistent results across different versions of our technology.
We do not guarantee any specific outcome, certification status, or score from the use of the Service. The issuance, maintenance, or revocation of any badge, certification, or trust indicator is at the sole discretion of Trusted Humans based on our then-current analysis criteria and policies.
Certain portions of the Service are offered on a subscription basis ("Subscription"). Subscriptions are billed in advance on a recurring periodic basis ("Billing Cycle"), the duration of which (monthly, annual, or otherwise) depends on the subscription plan selected at the time of purchase.
At the conclusion of each Billing Cycle, your Subscription shall automatically renew under identical terms unless: (a) you cancel it prior to the renewal date; or (b) Trusted Humans terminates it in accordance with these Terms. Cancellation may be effected through your account dashboard or by contacting our support team.
A valid payment method is required to process Subscription fees. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize Trusted Humans to charge all fees incurred to such payment method.
All prices displayed on the Service are exclusive of Value Added Tax (VAT). The applicable VAT amount shall be calculated and displayed during the checkout process based on your location and applicable tax regulations, in accordance with European Union Directive 2006/112/EC and Portuguese VAT legislation (Código do IVA). Invoices shall be issued electronically and made available via email.
Trusted Humans reserves the right to modify Subscription fees at any time. Any fee change shall become effective at the end of the then-current Billing Cycle. We shall provide you with no less than thirty (30) days' prior written notice of any fee increase, affording you the opportunity to cancel your Subscription before such change takes effect.
In accordance with Decree-Law No. 24/2014 of 14 February (transposing Directive 2011/83/EU on consumer rights) and applicable European Union legislation, if you are a consumer (i.e., a natural person acting for purposes outside your trade, business, craft, or profession), you have the right to withdraw from your Subscription contract within fourteen (14) calendar days from the date of contract conclusion, without providing any reason.
To exercise your right of withdrawal, you must inform us of your decision by means of an unequivocal statement (e.g., a letter sent by post or email) to:
Exception: By commencing use of the Service before the expiration of the withdrawal period, you expressly consent to the immediate performance of the contract and acknowledge that you will lose your right of withdrawal upon full performance of the Service. For Subscriptions, if you have expressly requested that service provision begin during the withdrawal period, you shall be liable for an amount proportionate to what has been provided until you communicated your withdrawal.
Upon valid exercise of withdrawal, we shall reimburse all payments received from you, using the same means of payment used for the initial transaction, within fourteen (14) days of receiving your withdrawal notice.
Trusted Humans may, at its sole discretion, offer Subscriptions with a free trial period. If billing information is required to access the free trial, you will not be charged until the trial period expires. Unless you cancel prior to the trial's conclusion, you will be automatically charged the applicable Subscription fee upon expiration.
We reserve the right to modify or discontinue free trial offers at any time without prior notice.
Subject to your statutory right of withdrawal as set forth in Section 7, refund requests for Subscriptions shall be evaluated on a case-by-case basis and granted at the sole discretion of Trusted Humans. This provision does not affect any mandatory consumer rights under Portuguese or European Union law.
By creating an account, you consent to receive electronic communications from us, including but not limited to service-related notices, account notifications, and, where separately consented to, commercial communications.
In compliance with Regulation (EU) 2016/679 (General Data Protection Regulation) and Portuguese Law No. 41/2004 (as amended), you may withdraw your consent to receive marketing communications at any time by following the unsubscribe instructions in any such communication or by contacting us directly.
The Service may permit you to submit, post, or transmit content, including but not limited to text, images, and other materials ("User Content"). You are solely responsible for your User Content, including its legality, accuracy, and appropriateness.
By submitting User Content, you grant Trusted Humans a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the operation and promotion of the Service. This license terminates upon deletion of your User Content or account, except where such content has been shared with third parties who have not deleted it.
You represent and warrant that: (a) you own or have the necessary rights to your User Content; (b) your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of third parties; and (c) your User Content complies with all applicable laws and these Terms.
Trusted Humans reserves the right, but has no obligation, to monitor, review, or remove User Content at its sole discretion, including content that we determine violates these Terms or applicable law.
The Service and its original content (excluding User Content), features, functionality, and underlying technology are and shall remain the exclusive property of Trusted Humans and its licensors. The Service is protected by copyright, trademark, patent, trade secret, and other intellectual property laws of Portugal, the European Union, and other jurisdictions.
Our trademarks, service marks, trade names, and trade dress may not be used in connection with any product or service without the prior written consent of Trusted Humans.
Nothing in these Terms shall be construed as conferring any license or right, by implication, estoppel, or otherwise, under any intellectual property rights.
The Service may contain hyperlinks to third-party websites or services not owned or controlled by Trusted Humans. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that Trusted Humans shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any content, goods, or services available on or through any third-party websites or services.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service shall immediately cease.
You may terminate your account at any time by discontinuing use of the Service and, where applicable, canceling your Subscription through your account settings.
Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Trusted Humans does not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results obtained from the Service will meet your requirements.
This disclaimer does not affect mandatory statutory warranty rights that you may have under Portuguese or European Union consumer protection law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Trusted Humans, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNTS PAID BY YOU TO Trusted Humans IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED EUROS (€100).
The foregoing limitations shall apply regardless of the legal theory upon which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise, and even if Trusted Humans has been advised of the possibility of such damages.
Nothing in these Terms shall exclude or limit liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable Portuguese or European Union law.
You agree to defend, indemnify, and hold harmless Trusted Humans and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) your User Content.
We process personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation) and Portuguese Law No. 58/2019 of 8 August. For detailed information about how we collect, use, and protect your personal data, please refer to our Privacy Policy.
We reserve the right to modify these Terms at any time. Material changes shall be communicated with at least thirty (30) days' prior notice via email or prominent notice on the Service. The "Last updated" date at the top of these Terms indicates when the most recent revisions were made.
Your continued use of the Service following the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
These Terms shall be governed by and construed in accordance with the laws of Portugal and applicable European Union law, without regard to conflict of law principles.
For consumers: If you are a consumer habitually resident in the European Union, you shall benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.
Subject to mandatory consumer protection provisions, any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Porto, Portugal.
In accordance with Regulation (EU) No 524/2013 and Portuguese Law No. 144/2015 of 8 September, we inform you that the European Commission provides an Online Dispute Resolution (ODR) platform, accessible at: https://ec.europa.eu/consumers/odr.
Before initiating any formal dispute resolution procedure, we encourage you to contact us directly to seek an amicable resolution. You may also submit complaints to the Portuguese Consumer Arbitration Centers (Centros de Arbitragem de Conflitos de Consumo) or other competent alternative dispute resolution entities.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, which shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the parties' original intent.
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and Trusted Humans concerning the Service and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
The failure of Trusted Humans to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by Trusted Humans.
You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. Trusted Humans may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties' successors and permitted assigns.
